The rules for using the Omniclock app and support site.

These Terms of Service (“Terms”) govern your access to and use of the Omniclock iOS application and the Omniclock support website (together, the “Service”). By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1) Eligibility
You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Service. If you are under 18, you may use the Service only with consent of a parent or legal guardian.
2) The Service
Omniclock provides timer functionality (and related features such as widgets and Live Activities) on supported Apple devices. The Service is not designed for mission-critical, medical, or safety-critical use. System conditions (e.g., power saving modes, OS constraints) may delay updates or notifications.
We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice.
3) Your responsibilities
You agree to:
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the app except where permitted by law.
- Not access or attempt to access the Service by automated means or in a manner that burdens or disrupts the Service.
- Not circumvent any security or access-control measures.
4) Accounts & data
Omniclock does not require a user account. Timer data and preferences are stored on your device. See our Privacy Policy for details on how we handle support emails, diagnostics, and analytics.
5) In-App Purchases & pricing
Some features may be offered for a fee in the future. Prices (if any) will be shown in the app and processed by Apple via App Store terms. Taxes may apply. Purchases are subject to Apple’s terms and refund policies.
6) License and intellectual property
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices you own or control, as permitted by the App Store Terms.
The Service and all related content, trademarks, and logos are owned by los.software or its licensors and are protected by law. Except for the license above, these Terms do not grant you any rights in the Service or its content.
7) User feedback
If you send ideas, suggestions, or feedback, you grant los.software a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate them without compensation, while we have no obligation to implement them.
8) Third-party services
The Service may rely on or link to third-party services (e.g., Apple services). Those services are governed by their own terms and policies, which you should review. We are not responsible for third-party services.
9) Software updates
We may provide updates that automatically install on your device. By using the Service, you consent to receiving updates (including critical fixes and changes to functionality).
10) Support
We aim to respond to support requests within one business day at [email protected]. Response times are not guaranteed.
11) Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, create risk or legal exposure for us, or if we discontinue the Service. Upon termination, your license ends and you must stop using the Service.
12) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that notifications will always be delivered on time.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOS.SOFTWARE AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claim arising out of or relating to the Service is limited to the greater of CHF 50 or the amount you paid (if any) for the Service in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain disclaimers or limitations; in those cases, the above applies to the fullest extent permitted.
14) Indemnification
You agree to indemnify and hold harmless los.software from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your use of the Service or your breach of these Terms.
15) Governing law & venue
These Terms and any dispute or claim (contractual or non-contractual) are governed by the laws of Switzerland, without regard to conflict-of-law rules.
Exclusive place of jurisdiction is the competent courts of the Canton of Zug, Switzerland.
If you are a consumer residing in the EU, the UK, or Switzerland, mandatory consumer protection rules of your place of residence may also apply, and you may bring claims in your local courts.
16) Export control
You must comply with applicable export and sanctions laws and may not use or provide the Service where such laws prohibit.
17) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the new Terms with an updated effective date and, where appropriate, provide notice in the app. By continuing to use the Service after changes take effect, you agree to the updated Terms.
18) Miscellaneous
- Entire agreement: These Terms constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
- Assignment: You may not assign or transfer these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
